Consent to the principles of personal data processing

MT Legal informs that it processes personal data of subjects:

  • during communication with data subjects;
  • during the duration of the business relationship with clients and suppliers;
  • in fulfilling the legal obligations of MT Legal; and
  • which are necessary for protecting the legitimate interests of MT Legal.

MT Legal is in the position of administrator when processing the personal data of the data subject.

MT Legal does not transfer the personal data of the data subject to a third country or international organization, nor does it use them for automated decision-making or profiling.

In connection with the processing of personal data, the data subject has the rights specified in the document Principles of Personal Data Processing in MT Legal.

Principles of personal data processing in MT Legal

When processing the personal data of data subjects, MT Legal always proceeds under the following principles arising from Article 5 of the GDPR:

  • the lawfulness, fairness and transparency principle – personal data of data subjects are processed only by MT Legal based on a valid legal title, fairly and transparently, i.e. to the extent and for the purposes stated in this information document;
  • the purpose limitation principle – personal data of data subjects are collected and processed by MT Legal exclusively for certain legitimate purposes explicitly stated in this information document, personal data are not processed by MT Legal in a way incompatible with these purposes;
  • the data minimisation principle – MT Legal processes personal data only to a reasonable, relevant and necessary extent in relation to the purpose which they are processed for;
  • the accuracy principle – MT Legal processes personal data in an accurate and, if necessary, updated form, MT Legal implements reasonable measures to ensure that personal data that are inaccurate, taking into account the purposes which they are processed for, are deleted or corrected without delay;
  • the storage limitation principle – personal data are stored and processed by MT Legal in a form that allows the identification of data subjects for no longer than it is necessary to achieve the purposes which they are processed for;
  • the integrity and confidentiality principle – MT Legal processes personal data in a way that ensures the proper security of personal data, including their protection by appropriate technical and organizational measures against unauthorized or unlawful processing and accidental loss, destruction or damage;
  • MT Legal employees, cooperating lawyers and managers follow the rules and procedures set out in the internal data protection directive, including the security measures put in place to protect personal data.

Exercising the rights of data subjects at MT Legal

Data subjects may exercise the following rights at MT Legal under the conditions set out in Articles 15 to 22 of the GDPR in relation to their personal data being processed:

  • The right to access the processed personal data

The right of access constitutes the data subject’s right to be provided with the following information from MT Legal: (a) whether his personal data are being processed, (b) for what purpose, (c) what personal data are processed, (d) whether his personal data are transferred to other recipients, (e) for how long is his personal data being processed, (f) information on his rights in relation to the personal data being processed. At the same time, he has the option of obtaining a copy of the processed personal data.

  • The right to correct processed personal data

The right to correction includes the right of the data subject to request from MT Legal the correction of incorrectly processed personal data or the addition to an incomplete processed personal data.

  • The right to delete processed personal data

The right to delete includes the right of the data subject to request from MT Legal the deletion of the processed personal data in the absence of a valid legal title for their processing. The data subject has no right to request from MT Legal the deletion of processed personal data if MT Legal has a valid legal title for their processing (i.e.

especially for the period when MT Legal is entitled to process the data due to performance of the contract or fulfilment of obligations stipulated by law).

  • The right to restrict the processing of personal data

The right to restrict processing includes the right of the data subject to request MT Legal to limit the scope of personal data processing in the following cases: (a) the data subject denies the accuracy of the personal data processed – processing may be restricted until a decision is taken; (b) the processing is unlawful but the data subject only requests restrictions on the processing; (c) MT Legal already needs personal data only to determine, exercise or defend legal claims; (d) the data subject has objected to the processing, until its settlement.

  • The right to the portability of processed personal data

The right to portability includes the right of the data subject to request MT Legal to process personal data in a structured, commonly used and machine-readable format for transfer to another administrator (another law firm), or the right to request their transfer directly to another controller in technically feasible cases. This right can be exercised only on the condition that the processing is based on the legal title of the performance of the contract or the consent of the data subject and is performed by MT Legal via the information system (automatically).

  • The right to object to the processing of personal data

The data subject is entitled to object in cases where the processing of his personal data by MT Legal is carried out based on the legal title of the legitimate interests of the administrator or for direct marketing. MT Legal shall not be entitled to further process the personal data of the data subject after the submission of the objections unless it demonstrates serious legitimate reasons for their further processing which outweigh the interests or rights and freedoms of the data subject or demonstrates the necessity of their processing to determine, enforce or defend its legal claims.

The above rights must always be exercised with the administrator of personal data, so it is not possible to exercise the above rights against MT Legal in cases where MT Legal is only in the position of the processor (e.g. for personal data processed in the administration of public procurement for clients).

The data subject is entitled to exercise the above rights with MT Legal in written paper form with an officially verified signature at the address Brno – Královo Pole, Jana Babáka 2733/11, postal code 612 00, in electronic form via an electronic message with a recognized el. signature delivered to the e-mail address info@mt-legal.com or via the data box ID: mrzn3bp.

MT Legal hereby informs data subjects that they can complain with the Office for Personal Data Protection under the conditions set out in Article 77 of the GDPR if they consider that the processing of their personal data by MT Legal has violated the GDPR.

MT Legal hereby informs data subjects that they have the right to effective judicial protection under the conditions set out in Article 79 of the GDPR if they consider that their rights have been infringed as a result of the processing of their personal data by MT Legal in breach of the GDPR.
